Longitudinal Submerged Arc Welding (LSAW)
Submerged arc longitudinal welding is a process in which the weld and the arc zone are “submerged” under a layer of meltable flux. Formed from steel plate rather than coils, LSAW tubing is used for tubing larger than 24 inch diameter or for extra heavy wall tubing.
Seamless tubing is produced when square billets of steel are heated and formed into cylindrical shapes called “rounds”. The round is heated white-hot in a furnace and rolled under high pressure. As the billet expands, a hole is formed in the center and a spherical piercing tip is pushed through. Larger diameter tubes then go through the mandrel rolling process where, after piercing, the tube shell is rolled through a mandrel mill with mandrel bars inside. This process creates a more standard outside diameter (OD) and controlled wall thickness (WT). Smaller diameter tubing is manufactured using the plug mill process.

All of these tube types are used throughout the oil and gas industry. Seamless tubing is popular because the lack of seams indicates fewer stress points and it has superior mechanical strength. They can also be molded into more precise and predictable forms. However, seamless tubes are significantly more expensive than welded tubes and have long delivery times because they are manufactured in very few places. Although the seam in a welded pipe is a potential weak point, constant advances in welding technology have greatly improved quality. Welded tubes also have more consistent wall thickness and much shorter delivery times.

It’s the additional chlorine molecules that protect the polymer’s carbon backbone, which in turn protects its structural integrity against heat. The increased heat resistance allows CPVC to perform at higher operating pressures than PVC.

Raw Materials for CPVC Piping
All CPVC products used in industrial equipment today—such as pipe, fittings, sheet metal, and duct—started out as two separate materials: chlorine and ethylene.
Chlorine is one of the by-products of chlor-alkali salt processing. Ethylene is derived from petroleum that is placed in a special facility called a cracker. Manufacturers then react these two materials together to form a new liquid chemical: ethylene dichloride (EDC).
Then EDC is dehydrated through an oxychlorination process, heated and finally decomposed into vinyl chloride monomer (VCM).
Vinyl chloride has no real use in its monomeric form as it is an unstable chemical intermediate and is gaseous under normal conditions. It must be stored under pressure to maintain a liquid state.
The vinyl chloride monomer must be converted into a polymer – a chain of monomers – to become strong, stable, and useful. To do this, manufacturers polymerize VCM in a high-pressure reactor to form polyvinyl chloride – or PVC.
Manufacturers produce the PVC resin and ship it to manufacturing facilities like Corzan Industrial Systems, where the PVC is used to make CPVC. PVC manufacturers can also supply the pellets to PVC manufacturers to be molded into finished PVC products.
PVC becomes CPVC

PVC is popular because it is strong and malleable. Manufacturers can heat it and process it into all sorts of products such as: B. Pipes, casings, cable insulation, signs and more.
To build on these benefits in CPVC, the PVC homopolymer undergoes a chlorination reaction. The chlorine (C2) and PVC resin react via a basic free radical mechanism, typically initiated by thermal and/or UV energy.
The diagram below shows the molecular difference between CPVC (left) and PVC (right), with the increase in large chlorine atoms (red) showing the increased protection of the carbon backbone.
In PVC, chlorine atoms occupy 25% of the binding sites, the rest being filled by hydrogen. In contrast, the CPVC carbon backbone has about 40% of the binding sites filled with chlorine. The increase in large chlorine molecules is key to protecting the backbone from decomposition.
The most noticeable change from PVC to CPVC is its heat deflection temperature and compressive strength at elevated temperatures. PVC is pressure rated for use up to 60°C (140°F), while CPVC is rated for use up to 93.3°C (200°F). When industrial processing applications involve higher temperatures and/or higher pressures, CPVC can be used.

After the CPVC resin is formed from the PVC, Corzan Industrial Systems blends it with additives that enhance other inherent properties, such as: B. the UV weather resistance.
Finally, the CPVC compound is manufactured as granules or powder. Melting CPVC resin into finished products
There are two common methods of manufacturing finished CPVC products: extrusion and injection molding.
Extrusion is used to create long, continuous shapes such as tubes and sheets. In extrusion, manufacturers take CPVC powder and feed it to an extruder. The extruder melts it and pushes it through a nozzle head, which distributes it as evenly as possible and gives it its final shape. As the material then moves through the processing equipment downstream of the extruder, it is corrected to correct any imbalances.
The tubing or sheet is then cooled, hardened, cut and prepared for use – typically in 10 or 20 foot sections of tubing or 4 foot by 8 foot sheet (in North America).
Extrusion is efficient for the production of tube and sheet as the machine can run continuously as long as material is fed into the system until a new product size needs to be produced.
CPVC injection molding
To make the rest of the CPVC products available on the market – like fittings, valves, flange adapters – manufacturers use CPVC pellets for injection molding. They use machines (like the one in the picture below) with a hopper on top that feeds a set amount of CPVC into the system.
The system uses a high-pressure screw to melt and press the CPVC into the desired shape. After a few seconds of cooling, the CPVC is dropped from the mold in perfectly shaped, ready-to-use pieces.

Who makes CPVC?

It all started in 1938 when Waldo Semon of BFGoodrich’s specialty chemicals team was looking for a way to make synthetic rubber because natural rubber made from trees was becoming too expensive. While PVC had been discovered in the 19th century, no one had found a practical use for it until Semon discovered a plasticization technology. This was the invention of vinyl – a soft, rubbery material originally used as a water-resistant coating for fabrics. During World War II it was used to insulate cables on military ships.

In the 1940s and 1950s, PVC was developed into rigid materials for pipe and other applications. In 1942 chlorine was added to the materials for the first time and research and development continued until 1958 when PVC chlorination technology was patented. CPVC was born – a thermoplastic made from a base PVC polymer enriched with chlorine molecules and special additives that give it the ability to withstand intense heat and pressure.
The first field trials began in 1960 when CPVC pipe was installed in a trial home built by the National Association of Home Builders. The success of this project led to the start of commercial production in 1962. Over the next year, the company’s CPVC was incorporated into research houses in the Baltimore, Maryland area. More than 30 years later, a team was able to take samples of the plumbing from the houses and, unsurprisingly, found them to be in perfect condition.
The growth of BlazeMaster
The company entered the fire protection market in 1984 with the introduction of BlazeMaster CPVC. With its ease of installation, low maintenance and natural resistance to corrosion, it offered the market a viable alternative to steel tubing.

Who owns JM Eagle?
Driving the defense has been the company’s owner and chief executive, Walter Wang, who has refused to settle. The company’s co-defendant, resin supplier Formosa Plastics, exited the lawsuit for $22.5 million and legal fees.

Fourteen years after the lawsuit was filed, the Los Angeles Federal Court judge who is presiding over the case returned his own verdict last month on what five cities and counties selected to have their cases heard first are entitled to: zero.
“There is no ‘real’ evidence of defects in the pipe,” U.S. District Judge George H. Wu ruled in a 67-page decision noting that the plaintiffs failed to excavate and test the pipe in question . “It is undisputed that they have not stopped using this pipe and thereby (for many years) receive, retain and continue to receive value.”
The ruling didn’t end the dispute, but it did deal a major blow to the plaintiffs in the lengthy legal saga that a JM Eagle attorney said posed an “existential” threat to the company — and has been fought accordingly. The company sued the plaintiffs’ attorneys twice, once for racketeering and another for defamation, cases that were dismissed on appeal. Along the way, it has hired several of its own lawyers and spent what it describes as “the equivalent of a huge fine” to fight the allegations.
The defense was pushed by the company’s owner and CEO, Walter Wang, who has refused to settle. The company’s co-defendant, resin supplier Formosa Plastics, dropped out of the lawsuit for $22.5 million and attorneys’ fees. But Wang, the son of the late Taiwanese billionaire who founded Formosa and JM Eagle’s predecessor company, said he was determined to fight to the end.
“I don’t want to settle because I didn’t do anything wrong. This is under my direct supervision. When I settle down, it’s not about money. It’s about ruining [my] whole reputation,” said Wang, a prominent Los Angeles businessman and philanthropist. “There was no way I could settle down, so I kept fighting and fighting. Even my sister and brother-in-law said to me, ‘Walter, you have to have an exit strategy.'”
Wang said he felt vindicated by the judge’s decision, but said it was too early for the company to celebrate. Plaintiffs are expected to appeal the verdict, and JM Eagle is still facing a class action lawsuit, which is proceeding on a separate track despite the whistleblower verdict.
Both types of cases can lead to high honors. Among the big-money whistleblower cases of recent years was one in which GlaxoSmithKline agreed to pay $3 billion in 2012 to settle all criminal and civil wrongdoing claims, including promoting off-label use his prescription drugs. Bank of America has agreed to pay $2.43 billion to settle a class action lawsuit with investors related to its acquisition of Merrill Lynch & Co. amid the financial crisis.
Eric Havian, lead counsel for plaintiffs in the whistleblower case, said Wu’s decision “effectively created a catch-22” for the water utilities because “they were sold substandard pipes in the first jury’s verdict.”
“However, since it’s buried underground and the cost of digging it up would require shutting down the water system for a few weeks or maybe even longer to exhume and test it, you can’t take any harm,” said Havian, who claims that only a “sample” of pipes would hold up in court.
Havian also disputed that there was no real-world evidence of JM Eagle pipe failures involving the plaintiffs, including one that occurred in the Calleguas Municipal Water District in Thousand Oaks. Wu didn’t allow it to be heard in court, he said, because the pipe was installed outside the timeframe of the lawsuit, which is undisputed. A JM Eagle representative also claims that the failure may have been caused by poor installation or pressure surges.
During pipe installation in Reno in 2002, an error occurred that was heard in court. The company representative said the cracks were caused by air pockets during pressure tests that were improperly conducted by the city. However, he acknowledged that JM Eagles’ investigation of the incident discovered a defect in a piece of pipe, allowing the company to honor its warranty and replace everything.
Havian said it was a clear example of a “bad” whistle and he expects the issue of failure to be addressed on appeal. He also said that nothing prevents the litigation from continuing with other plaintiffs.
The damages case relied on the plaintiffs’ experts, who developed an elaborate design model – based on JM Eagle’s internal testing – and claimed the pipe could fail sooner than if it met standards. A jury hearing testimonies hung on the damages issue in November 2018, prompting the company to ask Wu to make its own decision. Wu dismissed the expert testimony, noting that the analysis was untested and lacked peer review, among other shortcomings.
John Nockleby, a Loyola Law School professor who has written on tort law, said Wu appears to have settled for just one sample large enough to test — although an expert would then have to create a longevity test.
“I don’t know if such a test would be feasible, but the court seemed to be looking for such evidence,” said Nockleby, who described the decision as a “complete victory for the defendant.”
The litigation began in 2006 when Phillips & Cohen, a leading whistleblowing law firm of which Havian was a partner at the time, filed a complaint on behalf of the federal government, several states and numerous municipalities, as well as a former quality assurance engineer at JM Eagle who said, he was fired after raising questions about the quality of the company’s whistle.
The lawsuit, which covered tubing manufactured from 1996 to 2006, accused JM Eagle of using inferior resins and other raw materials, overspeeding its tube-making machines, and “picking out” tubing for testing to certifying agencies in its pursuit of profit To deceive. according to a second amended version of the complaint.
In the years leading up to the unsealing of the first case in 2010, the federal government investigated the whistleblower’s complaint alleging violations of the False Claims Act, a Civil War-era law designed to ensure the military was not provided with substandard goods from suppliers sold. It allows private whistleblowers to receive up to 30% of the damages in certain cases.
The government eventually decided not to pursue the case, nor did California or several other states under their own false allegation laws — as JM Eagle pointed out in his defense. Havian said that’s because the pipe was largely purchased by local governments and water districts. He also notes that the federal government investigator testified on behalf of the plaintiffs.
The first trial, conducted over two months in 2013, was reduced to five “model” plaintiffs — the city of Palmdale, the Thousand Oaks water area, and public water utilities in Virginia and Nevada, including Reno — with the rest considered later. According to a PowerPoint presentation in court filings, which Havian said was shown during the closing arguments, the plaintiffs produced emails and documents from the company raising questions about pipe quality and presented internal test results they claimed were used during the course would have decreased over time.
The company says the plaintiffs seized the results of tests on tubes under development or used to diagnose manufacturing problems. It has also accused whistleblower John Hendrix of being a disgruntled employee who was fired after he requested a bribe payment from a customer who had complained about receiving a bad pipe – and produced a signed affidavit from the customer, in which Hendrix asked him to seek a larger settlement and give him a portion of the proceeds.
Hendrix, who was involved in the Formosa settlement, was not available for comment but has previously denied the allegations. Havian called them wrong.
Attorney David Bernick, representing the company in the damages case, said Havian took advantage of Wang’s efforts to build a company composed of aging factories acquired from other pipe companies, first Formosa and later Wang, who acquired the shares in 2005 from Formosa Plastics. He said the company essentially has a “very strong record” of compliance.
Havian “created an image of shoddy manufacture, essentially what it was,” Bernick said. “Yes, these plants had problems at certain points in time – different plants in different places. But that doesn’t mean these plaintiffs got a bad whistle.”
The jury in the first trial found that JM Eagle “knowingly” and “falsely violated consistent compliance” with standards of the American Water Works Assn. and UL – two major certification organizations – to the five plaintiffs who built 26 pipeline projects. As a result, JM Eagle is still liable for penalties of up to $260,000, a nominal amount compared to the potential damages the company feared.
The five cities and counties declined to comment or could not be reached for comment, or referred questions to their attorneys.

JM Eagle was sued for defamation and trade defamation. His interpretation of the ruling is that the company was found not to produce every single stick of its whistle to industry standards, a benchmark no company could match.

A spokesman for JM Eagle indicated that the opinion was not unanimous and that the majority only summarized, not substantiated, the evidence presented by the plaintiffs. He also said the appeals court found in its opinion that the trial court found that it was not legally true that JM Eagle was held liable for the manufacture and sale of faulty water mains. He said Wu’s decision in the whistleblower case further supports this point.
Havian was also sued for racketeering by the company, who accused him of helping Hendrix copy emails, record conversations, and otherwise illegally gather evidence. A New Jersey appeals court ruled that the dispute should be settled in Wu’s court as part of the whistleblower case.
“The whole legal battle was scorched earth,” Havian said. “I’ve never had a case where I’ve been sued by a defendant for racketeering or anything else. They never gave up. You will never give up.”
After losing the first trial, JM Eagle brought in Bernick, a high-profile trial attorney and former Philip Morris general counsel, for the damages phase. Bernick said the case posed an existential threat to the company, although Wang said it sells enough pipes a year to circumnavigate the globe several times – with just 0.1% showing defects, 70% of which can be traced back to installation .
“It’s all a disaster in only one place, which is in federal court in the Central District of California and in the eyes of the plaintiffs,” Bernick said.
The class action faces a certification hearing, which would essentially determine whether there is a class of plaintiffs with common claims that are best resolved collectively rather than individually. It is open to private buyers of JM Eagle tubing and government agencies in more than two dozen states.
Lawyers for the plaintiffs filed an updated complaint last month following the whistleblower ruling at the request of Wu, who is also leading the class action lawsuit. Even if he grants the certification, there would have to be a jury trial, which could result in damages.
“We’re going to try to build a model of what this company should give back,” said David Birka-White, the class action’s lead counsel, who noted that Wu had issued a preliminary ruling in favor of the class certification in 2012 before the whistleblower trials.
Bernick said Wu’s recent decision not to award damages dealt a serious blow to the class action lawsuit. “The class action lawsuit is kind of tag-along,” he said.
However, Nockleby cautioned that the class action will assert causes of action unrelated to the whistleblower case – such as false advertising – and seek punitive damages, so it “is not bound by the same limitations on damages.”
Wang acknowledged that the lawsuit had damaged the company’s reputation, particularly after the whistleblower lawsuit was unsealed and later after the initial verdict. He declined to comment on the company’s finances but said it lost business and was unable to sell in the Nevada and Virginia markets. “Our reputation hasn’t been shaken, but it has been damaged,” he said.
Whatever the damage, JM Eagle is still the world’s largest plastic pipe manufacturer, according to a February report by IBISWorld. It said the company had a 12.4% share of the US market, almost twice the size of its closest competitor. The report, which was completed before the coronavirus outbreak was in full swing, projected that JM Eagle would grow sales to $2.5 billion this year.
The company could potentially appeal and settle the class action by agreeing to a settlement. Wang said that will not happen after 14 years. “Absolutely not,” he said.
